Description and size

All carpets in our collection are handmade by artisans and are unique one off pieces that vary in size, colour and quality. We take every care to ensure that the description and specification of each piece is correct. However, antiques by their very nature have unique characteristics and specifications thus their descriptions are not intended to be binding and are only intended as guidance.

 

Representation and colour

We go to great lengths to accurately present our carpets, however from time to time due to individual users monitors, resolutions and settings items may appear differently. We are unable, as such to accept any liability for colour misrepresentation and strongly advise customers to contact us directly first before making a purchase if you have concerns.

 

Making a purchase

Our extensive range of one off antiques and vintage pieces are viewable online and can only be purchased directly through our trade showroom and warehouse. Our webshop

A limited range of rugs can also be purchased directly online through our webshop. Simply click buy on the item required and this piece will be placed into your shopping cart. When you have finished, click on the checkout icon where your total bill will be listed and calculated.

 

Placing a webshop order

By placing an order through our webshop you will be deemed to have read, understood and agreed to these terms and conditions. Agreement

These conditions govern our relationship with you. Any changes to these conditions must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what Kennedy Carpets (Ken Commercial Services Ltd) and you are expected to do. You confirm that, in agreeing to accept these conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these conditions and you agree that you shall have no remedy in respect of any representation. Your statutory rights are not affected by these terms and conditions. Nothing in this clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the conditions.

 


Prices

The prices payable for goods & services set out on our webshop are pound sterling and includes UK VAT.

 

Payment & security

All webshop orders require full payment at the time of being placed. This can be done using our automated checkout, alternatively we are happy to process your order over the phone if you prefer to talk to an individual. Our secure payment partner is PayPal, who take full responsibility for capturing and storing your payment information on their secure servers.
 

Confirmation

Once your webshop order has been received we will email you an order confirmation outlining the item you have chosen to purchase. We kindly ask you to take a moment to ensure the your order is correct. If you find an error please email our team immediately at service@kennedycarpets.com or by phone on +44 (0) 208 9977669.

 

Lead times

Typically we deliver webshop orders within 3-5 working days of purchase. A member of our team will contact you within 72 hrs of placing your order to arrange your delivery. Please be aware whilst we do our best to honour the lead times quoted these times are estimates only and are not contractual.

 

Delivery

All Webshop orders will be delivered to the address you provide at the time you place your order online. If your delivery details change prior to dispatch please email us at service@kennedycarpets.com.  Please note once goods have been dispatched we cannot change delivery details or accept a cancellation. Dispatched goods can be returned in line with our 21 day return policy. Any items refused upon delivery may be subject to an additional cancellation / return delivery fee.

 

Delivery to a different address

We are pleased to arrange delivery of your order to an address that is different to your credit or debit card billing address but, if you have not purchased from us before, we may contact you before we process your order to verify that your credit or debit card is not being used fraudulently.

 

Multiple deliveries

Where possible we will always group your order and ship it together, however this is not always possible we reserve the right to dispatch items separately.

 

Delivery notification

When your order is ready to ship we will advise you. Please ensure someone is available to receive your order at the nominated address. Failed deliveries will be returned to a local depot and our delivery agents will leave a calling card. A further 2 delivery attempts will be made within a 5 working day period from the original delivery date before goods are automatically returned to us.

 

Failed deliveries

Sometimes things happen and orders are returned to us. In these instances we reserve the right to charge a re-delivery fee. Failed deliveries for which a refund is subsequently requested may also be subject to an administrative fee.

 

Incorrect delivery

In the unlikely event that your order is incorrect please notify our customer service team within 48 hours of receipt by email at service@kennedycarpets.com. We will do our best to rectify the issue as quickly as possible. In the interest of speed we kindly ask customers to send us a picture of the piece received and its label which helps us identify the issue and provide a solution quickly.
 

Natural character

Antique and vintage carpets by their very nature have their own characteristics and colourful histories and are not sold as new. If you have concerns with the item delivered or believe it is faulty please contact our customer service team immediately. We kindly ask customers to send us a picture so we can understand the nature of the issue.
 

Return policy

We all know it can be disappointing when an item is not quite right or doesn't fit where we expected it to. As a family run business we go out of our way to ensure your order is right for you, hence we don’t sell our antiques and vintage items online directly. We prefer to communicate your needs verbally and where possible encourage viewing at our trade showroom prior to purchase and delivery.

If you are not completely happy, you may return your order to us within 21 days of receipt for a full refund or exchange - provided that the item is returned complete and in its original condition. To return an item, you must first contact us by email to - service@kennedycarpets.com

 

Returning at item

If you wish to return an unwanted item we are happy to facilitate this under our 21 day return policy. It is recommended that you keep the original packaging in order to make returning items easier. If you no longer have the original packaging we can suggest alternatives or send you new packaging.

We are unable to provide free collections and as such you are  fully liable for the costs of returning an item to us. We suggest you use a reputable carrier and insure the item to cover any potential damage or loss in transit. If you are unable to facilitate this we are happy to arrange a courier however this will be chargeable and deducted from your final refund.

 

Complaints procedure

If you have any queries, issues or complaints in relation to any purchases made from Kennedy Carpets, please contact service@kennedycarpets.com If after following our internal complaints procedure you still feel that we have not satisfactorily resolved your complaint, then you can access the EU's Online Dispute Resolution platform by following this link.

 

Events beyond our control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our control.

 

Title and risk

We retain ownership of any goods or services ordered until we have received full payment for such goods or services.

 

Your right to cancel

Webshop orders can be cancelled up to the point of dispatch. Simply email us at service@kennedycarpets.com  Once your order has been shipped or delivered your have the right to cancel or return items under our 21 day return policy. This does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.

 

Our right to cancel your order

Sometimes we are unable to complete customers orders. If we need to cancel your order we will notify you by email and provide a full refund. We will do our best to provide alternatives however we are unable to offer additional compensation for any inconvenience or disappointment caused.  

 

Intellectual property

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of our website and webshop shall remain at all times the sole property of Kennedy Carpets. You are permitted to use this material only as expressly authorised by us Ken Commercial Services Ltd trading as Kennedy Carpets.

 

Right of use

You acknowledge and agree that the material and content contained within the website is made available for your use only and that you may (if necessary to make a purchase) download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of our website is strictly prohibited.  You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

 

Data protection and privacy

We understand that many people still worry about submitting personal details on the Internet – especially their credit/debit card numbers. We can assure you that any information you provide to us will remain safe and secure, we promise never to release your personal details to any third party for mailing or marketing purposes. When you make a purchase from our webshop, we collect certain personal information from you (for example: your name, email address, payment address and details). All such information is held on secure servers. Our website is provided on an "as is" and "as available" basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the website, or any transaction that may be conducted on or through the website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no guarantees that our website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the our website. We will not be responsible or liable to you for any loss of content or material downloaded or transmitted through our website.  To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to our products. This does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the conditions for:

Consumer contracts regulations

From 13 June 2014, the Consumer Contracts Regulations - which implements the European Consumer Rights Directive became UK law - this new law applies to all purchases made at a distance, online or over the phone. Kennedy Carpets are proud to confirm that we fully abide and uphold the principles of the Consumer Contracts Regulations and will from time to time update our conditions in line with any changes that may take place to this governance. Third party rights

A person who is not a party to this contract has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this contract but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

 

Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
